End-User License Agreement

1. Grant of License

Subject to the terms of this Agreement, Licensor grants Licensee a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software solely for lawful purposes, including personal and commercial penetration testing, in accordance with the tier level purchased.

2. Restrictions

Licensee shall not:

• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software.
• Rent, lease, lend, sell, redistribute, or sublicense the Software.
• Use the Software for any unlawful, unauthorized, or malicious purposes, including but not limited to unauthorized access to systems, data exfiltration, or activities that violate applicable laws and regulations.
• Use the Software in any manner that could damage, disable, overburden, or impair any server or network connected to the Software.

3. Ownership

The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including all intellectual property rights therein. Licensee acknowledges that no ownership rights are transferred under this Agreement.

4. Subscription and Updates

• Licensee is entitled to Limited lifetime access* to the Software modules available under the tier subscribed to at the time of purchase.
• Upon termination or cancellation of the subscription, Licensee retains access to the Software modules previously granted but will no longer receive updates, including new features, enhancements, or security patches.
• Continued access to new features in higher tiers requires an active subscription upgrade.

5. Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement immediately if Licensee fails to comply with any term of this Agreement. Upon termination, Licensee must cease all use of the Software and destroy all copies.

6. Disclaimer of Warranties

The Software is provided "as is" without warranty of any kind. Licensor disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall Licensor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to this Agreement or the use of the Software.

8. Compliance with Laws

Licensee agrees to use the Software in compliance with all applicable laws, regulations, and guidelines. Licensee is solely responsible for ensuring that their use of the Software does not violate any laws or regulations.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

10. Entire Agreement

This Agreement constitutes the entire agreement between Licensee and Licensor regarding the Software and supersedes all prior or contemporaneous understandings.
